Common class-confusion examples

What trademark class are phone cases in?

Phone cases and many electronic accessories usually start with Class 9. Retail services, repair services, or non-electronic cases may require a different or additional class.

What trademark class covers clothing?

Clothing goods commonly point to Class 25. An online store may also evaluate Class 35 for retail services, but it does not replace the product class.

Is SaaS in Class 9 or Class 42?

Downloadable software often points to Class 9, while hosted SaaS and software development services often point to Class 42. The delivery model matters.

What trademark class covers cosmetics?

Non-medicated cosmetics commonly start with Class 3. Medicinal products, supplements, beauty devices, and retail services can fall elsewhere.

Are coffee and coffee mugs in the same class?

No. Coffee is commonly reviewed under Class 30, while coffee mugs usually start with Class 21. A single brand can require multiple classes.

Do all pet products use one trademark class?

No. Pet food, toys, leashes, bowls, grooming products, and retail services may fall into different classes. Search the specific product.

A class heading is only a broad guide. Protection depends on the goods and services terms actually listed in the application, so finding a class number is only the first step.

A business can need several classes when the same brand covers products, software, retail services, repair, education, or other activities.

Retail services do not replace the product class

Class 35 can cover retail, advertising, and business services. It does not automatically protect clothing, cosmetics, electronics, or other goods sold in a store. Evaluate the product class first, then decide whether retail services also matter.

A practical four-step class check

  1. List the products and services you actually offer or genuinely plan to offer.
  2. Search each concrete item instead of a broad industry word such as “beauty” or “pet.”
  3. Check adjacent classes created by delivery method, material, function, or retail activity.
  4. Verify accepted wording in WIPO, TMclass, or the target office database before filing.
